This chapter discusses the fiduciary obligations of sponsors and managers of pension funds. Pension plan fiduciaries have a clear obligation to invest prudently and for the exclusive benefit of plan beneficiaries. However, the definition of both prudence and “exclusive benefit” remains the focus of considerable legal and regulatory debate and uncertainty. What is clear is that fiduciaries must be familiar with the issues surrounding their investment strategies and their specific implementation.
