This chapter deals with employment and reservation of jobs for persons with disabilities under the Persons with Disabilities (PWD) Act in India. It discusses criticisms on the entire concept of identification of jobs and the quota system of reservation under the Act and proposes a way forward for employment-related aspects of the PWD Act. It analyses the provisions of Article 16 of the Indian Constitution which refers to equal opportunities and reservation in public employment and evaluates how it has addressed disability. It stresses the need to re-evaluate whether the provisions for equality in employment and the identification and reservation of jobs under the PWD Act is truly the only way of ensuring equal opportunities.
