A Taxonomy of Dismissals

This chapter discusses and suggests that despite the diversity of issues of justice that are posed by dismissals, it is possible to approach the substantive and procedural questions of justice. This can be achieved with the aid of a clear taxonomy of the different types of dismissals. The discussions found in this chapter aim to distil from the apparently chaotic statutory provisions a coherent scheme of principles of fairness in dismissals that presents the legislation in its best light.
