This chapter discusses the rights which free movers enjoy. It examines the rights of those engaging in economic activity and the rights enjoyed by those not so engaged. The Community has recently modernized the legal instruments governing the rights which attach to free movement. Directive 2004/38/EC is primarily about entry and residence, and the ability of the Member States to restrict these matters on grounds of public policy, public security, or public health. It covers free movement and seeks in a single instrument to deal with qualified resident as well as free movement of the employed, self-employed, and service providers and recipients.
