In the second half of 2008, Herbert Smith LLP conducted a survey of senior dispute resolution practitioners in their own firm, and among other members of the Commercial Litigators' Forum, into how the Civil Procedure Rules (CPR) are working today. This chapter presents the results of this survey and considers how the CPR have worked in practice from the perspective of the commercial solicitor and what conclusions can be drawn ten years on.
