The European Court of Human Rights has managed to articulate the idea of diversity into discrete principles that are still very much in a testing phase. However, it is possible to discern the design of Strasbourg to carve out a Marketplace of Religions where religious monopolies are gradually dismantled and the neutrality of the state is applied contextually. It is unclear whether the ECtHR has a secularist theory of rights, but this chapter suggests that that is inescapable.
