The second chapter provides general background on the debate over nonbeneficial pediatric research. It considers what constitutes nonbeneficial pediatric research, as well as current regulations governing such research, recent attempts to increase pediatric research, and pertinent law in the U.S. This chapter also evaluates court cases relevant to nonbeneficial pediatric research and reveals the extent to which the courts are skeptical, at best, of its appropriateness, even while granting its importance.
