When determining whether a civil society organization has charitable status, the orthodox position has it that the activities carried on in pursuit of its purposes are not relevant. This article considers the extent to which this is correct and argues that there are in fact a number of situations in which it is appropriate to consider the potential or actual activities carried on by a prospective charity. It also considers the impact of the decision in R (on the application of Independent Schools Council) v Charity Commission [2011] UKUT 421 (TCC), [2012] Ch 214 and the desirability of placing even greater emphasis on a charity’s activities in light of the regulatory consequences of charitable status.
