In a decision of February 2008, the ECJ held that the German Republic had not breached the provisions of the Protected Designation of Origin (PDO) Regulation as it does not provide that Member States are obliged to introduce measures against the infringement of PDOs, but that Member States are merely obliged to adopt legislation sufficient to protect interested subjects, including consumers, involved or harmed by the infringement.
