The German Federal Supreme Court (Bundesgerichtshof) has clarified the circumstances in which the image of a famous person can be protected as a trade mark, deciding that the image of a famous person lacks distinctiveness for the goods and services that the relevant consumer would associate with the famous person and would interpret as being merely a descriptive reference to the person depicted.
