This article advocates the revocation of the ban on dual protection set out in Article II Section 8 of the German Act on International Patent Conventions (IntPatÜG), or at least to clarify by amending the provision that it does not cover European patents with unitary effect. Otherwise the number of national patent infringement proceedings will become minimal following the entry into force of the Agreement on a Unified Patent Court (AUPC), especially after expiry of the transitional period under Article 83 AUPC.
