Whether, on the basis of the International Convention for the Unification of Certain Rules relating to Penal Jurisdiction in Matters of Collision and Other Incidents of Navigation (‘Penal Jurisdiction Convention’), a state had jurisdiction over a case of culpable homicide resulting from a collision between an foreign flagged vessel and a domestic vessel in the territorial waters of the that state.

Whether, in a case involving an arrest warrant for culpable homicide resulting from a collision between vessels in the territorial waters of a member state and in the interpretation of the Penal Jurisdiction Convention, a reference for a preliminary ruling before The European Court of Justice was justified under the Treaty on the Functioning of the European Union.
