The treatment of divorced women by Portuguese social security and family law is reviewed. The limited protection offered by the social security system is noted and the limitations of the traditional treatment of assets at the breakdown of a marriage or at the point of inheritance are also observed. It is argued that Portuguese family law needs to give more attention to the 'new property' of pension rights by incorporating them into the traditional understanding of community property.
