This article considers the provisions made by the Romanian government and legislator to improve the circumstances of children living in institutional care in Romania. This has involved an attempt to alter child welfare and child protection policies in a radical way. The author considers the criticisms made of these measures by the Commission of the European Union, and argues that the programme of the Romanian authorities must be considered in the light of the conditions prevailing in the country before the fall of the Ceausescu regime, and the general socio‐economic conditions of the population as a whole.
