This contribution examines recent judicial interpretation of the statutory provisions governing the distribution of assets and income on divorce in England and Wales, and questions the capacity of judicial law-making to formulate social policy in the absence of legislative intervention. It reveals a tension between pragmatism and creativity, and highlights fundamental issues of principle relating to the financial dissolution of the marriage partnership which remain unanswered.
