The article draws attention to the particularly vulnerable situation of implementing the principle of the best interests of the child in national legislation and practice concerning cases of expulsion of parents illegally residing in the country and separation of children and parents as a consequence of the expulsion decision. The comparative approach used in the article helps to clarify the shortcomings and challenges of different legal systems when forming and exercising national immigration legislation.
