The offence of supplying drugs is aggravated for the purpose of sentencing where a person of the age of 18 years or over supplies drugs in the vicinity of a school or uses a courier under the age of 18 years. The Drugs Act 2005 inserted a new subsection into s 4 of the Misuse of Drugs Act 1971, which affects sentencing but does not create an offence.
