For the purpose of the Proceeds of Crime Act 2002 a defendant is deemed to have a criminal lifestyle if the offence (or any of the offences) concerned either is specified in sch 2 to the Act; or, constitutes activity forming part of a course of criminal activity; or, is an offence committed over a period of at least six months and the defendant has benefited from the conduct which constitutes the offence—provided that in the latter two instances the defendant obtains relevant benefit of not less than £5 000.
