Any provision of the law of the European Union that is not directly applicable but that grants individual rights against the state with immediate effect (i.e. before it has been implemented by domestic legislation). EU directives have direct effect (Van Duyn v Home Office [1974] 1 WLR 1107 (Ch), case 41/74 [1974] ECR 1337). See Community law; Community legislation.
