Failure by a detained person to account for his presence at a place at or about the time of the offence, which an investigator reasonably believes may be attributable to his participation in the offence and for which the investigator has asked him to account. If the detained person fails or refuses to account for his presence, any court in subsequent proceedings may draw such inferences as appear proper (s 37, Criminal Justice and Public Order Act 1994).
