Article 8 of the European Convention on Human Rights and the Human Rights Act1998 guarantee respect for family life. The right to family life extends beyond formal relationships and legitimate arrangements (Marckx v Belgium (App no 6833/74)  ECHR 2). This right is a qualified right: interest can be used to justify an interference with it providing that this is prescribed by law. The right to marry and found a family (the right to procreation) is contained in Article 12 of the Convention.
