Receipt of a programme included in a broadcasting or cable programme service provided from a place in the UK with intent to avoid payment of any charge applicable to the reception of the programme. It is a summary offence, contrary to s 297 of the Copyright, Designs and Patents Act 1988. Section 297A of the Act (inserted by the Conditional Access (Unauthorised Decoders) Regulations 2000 (SI 2000/1175) ) creates an offence triable either way concerned with certain commercial activities in relation to unauthorized decoders (that is apparatus to enable receipt of encrypted transmissions).
