Gaining unauthorized access to a computer system. This is currently a summary offence under the Computer Misuse Act 1990; when the Police and Justice Act 2006 (s 35 (3) comes into force the offence will become triable either way. Under the 1990 Act it is also an offence, triable summarily or on indictment, to engage in hacking with the intention of committing another offence (e.g. theft, diverting funds), or to destroy, corrupt, or modify computer-stored information or programs while hacking. This offence can be committed either through using one computer to gain access to another computer or simply by gaining access to one computer only. Copyright protection applies.
