Treatment that causes intense physical and mental suffering (Ireland v UK (1978) Series A no 26 2 EHRR 25). The prohibition on inhuman treatment or punishment as set out in Article 3 of the European Convention on Human Rights is part of UK law as a consequence of the Human Rights Act1998. This right is an absolute right. Public authorities have a limited but positive duty to protect this right from interference by third parties.
