Quick Reference

[Latin: the unwritten law]

The common law, as opposed to statute. This may seem a strange term for law that clearly is written to the extent that it is to be found printed in the law reports. However, the term refers to a time before written reports existed, when rules and principles were conveyed by example and retained by memory alone.

Subjects: Law.
