In a case of unfair dismissal an Employment Tribunal can order an employer to take back the employee and find him or her ‘employment comparable to that from which he was dismissed or other suitable employment’. However, in only a minority of unfair dismissal cases is re-engagement ordered and the majority of employees receive financial compensation for the loss of their job. If an employer refuses to accept re-employment, then an ‘additional award’ can be made to the employee.
