A tenancy that arises when a tenant is holding over and the landlord has not indicated whether or not he agrees to the tenant's continued occupation. If the landlord gives his express agreement, the tenancy becomes a tenancy at will: if the landlord accepts periodic payments by way of rent, the tenancy becomes a periodic tenancy.
