The document creating and setting out the terms of a trust. It will usually contain the names of the trustees, the identity of the beneficiaries, and the nature of the trust property, as well as the powers and duties of the trustees. Trusts of land must be declared in writing; trusts of other property need not be although there is often a trust deed to avoid uncertainty.
