A witness identified in s 16 of the Youth Justice and Criminal Evidence Act 1999 as: under the age of 17 at the time of the hearing; suffering from a mental disorder as detailed under the Mental Health Act 1983; significantly impaired in relation to intelligence and social functioning; or with a physical disability or suffering from a physical disorder. The Act provides for the making of special measures directions to assist these vulnerable witnesses in giving evidence. Witnesses who qualify for such assistance under the Act are termed eligible witnesses. See also special measures.
