In criminal proceedings before the magistrates' courts, a prosecutor may seek leave of the court to withdraw a charge or summons at any time before the defendant is called upon to enter a plea. The court should grant leave and discharge the defendant, unless there is bad faith on the part of the prosecutor or unfairness to the defendant. Withdrawal is no bar to future proceedings for the same offence.
