A penalty imposed on a defendant duly convicted of a crime by an authorized court. The punishment is declared in the sentence of the court. The two basic principles governing punishment are * nullum crimen sine lege (no crime without a law) and * nulla poena sine lege (no punishment without a law). See feature Theories of Punishment.
