Abstract

This article explores the distinctive facet of Guernsey foundations that allows a founder to create classes of enfranchised and disenfranchised beneficiaries with different rights in respect of accessing information about the foundation. The authors set out the statutory framework provided by the Foundations (Guernsey) Law, 2012, and consider the implications for founders, councillors, and beneficiaries in relation to the control of the flow of information concerning the foundation.
