In the preceding chapter, the mechanisms for protecting economic interests were procedures for dealing retrospectively with bilateral disputes concerning the civil law rights and obligations of a person who alleges that some economic interest of his has been impeded and with the person who allegedly impeded that interest; and those procedures are ones in which both the interferer and the interferee play a part. This chapter discusses the mechanism for protecting economic interests wherein one or more, or all, of the above-mentioned characteristics of procedural alternatives for safeguarding legal interests were lacking. These methods for protecting economic interests include compensation schemes, regulation, and risk management.
